Assumption of risk
Participation in speedboat rides, jetski activities, party boat cruises and other watersports at Hartbeespoort Dam involves inherent risks including but not limited to drowning, collision, capsizing, weather changes, mechanical failure, personal injury, and loss or damage to property.
Release of liability
In consideration of being permitted to participate, the guest releases, waives and discharges HydroRush, its owners, employees, skippers, agents and affiliates from any and all liability, claims or demands arising out of or connected with participation, to the fullest extent permitted by South African law.
Compliance
Guests agree to wear a life jacket at all times on the water, follow all instructions from the skipper or instructor, and comply with South African Maritime Safety Authority (SAMSA) regulations. Guests confirm they are not under the influence of alcohol or drugs when boarding.
Medical fitness
Guests confirm that they (and any minor they represent) are medically fit to participate and have disclosed all relevant medical conditions. Guests authorise HydroRush to arrange emergency medical treatment if required, at the guest's own cost.
Minors
A parent or legal guardian must sign on behalf of any guest under 18 and consents to their participation on the same terms.
Media release (optional)
Guests may grant HydroRush permission to use photos or video taken during the activity for marketing on its website and social media, without compensation. This part of the waiver is optional and can be declined without affecting your booking.
Governing law
This waiver is governed by the laws of the Republic of South Africa.
